Vispair GmbH (bundan b\u00f6yle \u201cVispair\u201d olarak an\u0131lacakt\u0131r) ve m\u00fc\u015fteri (bundan b\u00f6yle \u201cm\u00fc\u015fteri\u201d olarak an\u0131lacakt\u0131r, topluca: \u201ctaraflar\u201d) aras\u0131nda ilgili i\u015f pozisyonu ilan\u0131nda veya ilan onay mektubunda belirtilen bo\u015f pozisyonu doldurmak i\u00e7in bir \u00e7al\u0131\u015fan yerle\u015ftirmek amac\u0131yla personel yerle\u015ftirme alan\u0131ndaki mevcut ve gelecekteki t\u00fcm i\u015f ili\u015fkileri i\u00e7in ge\u00e7erlidir.<\/p><p>\u00a0<\/p><p class=\" translation-block\"><strong>\u00a72 Gizlilik ve veri koruma <\/strong>\n<br>\nSipari\u015fi ba\u015far\u0131l\u0131 bir \u015fekilde yerine getirmek i\u00e7in, m\u00fc\u015fteri Vispair'e pozisyonu doldurmak i\u00e7in gerekli t\u00fcm bilgileri sa\u011flar. Vispair bu bilgileri gizli tutar ve yaln\u0131zca belirli bir yerle\u015ftirme emrinin ger\u00e7ekle\u015ftirilmesi i\u00e7in kullan\u0131r.  \n\n \n\nBuna ek olarak, Vispair m\u00fc\u015fteri verilerini gizlilik politikas\u0131na uygun olarak gelecekteki i\u015f ili\u015fkileri i\u00e7in saklar ve bir y\u0131ll\u0131k bir s\u00fcre sonunda siler veya m\u00fc\u015fterinin r\u0131zas\u0131yla bir y\u0131l daha uzat\u0131r. Verilerin Vispair taraf\u0131ndan derhal silinmesi, herhangi bir yasal ar\u015fivleme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmamas\u0131 ko\u015fuluyla, m\u00fc\u015fterinin yaz\u0131l\u0131 talebi \u00fczerine ger\u00e7ekle\u015fir.<\/p><p>M\u00fc\u015fteri, i\u015fe al\u0131mla ba\u011flant\u0131l\u0131 olarak al\u0131nan ba\u015fvuru sahipleri hakk\u0131ndaki t\u00fcm bilgileri yaln\u0131zca yetkili ama\u00e7lar i\u00e7in ve iletime uygun olarak kullanmakla y\u00fck\u00fcml\u00fcd\u00fcr. \u0130\u015fe yerle\u015ftirme faaliyetinin sonunda m\u00fc\u015fteri, sa\u011flanan belgeleri iade edecek ve herhangi bir yasal saklama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmamas\u0131 ko\u015fuluyla ba\u015fvuru sahiplerinin t\u00fcm ki\u015fisel verilerini silecektir.\u00a0<\/p><p>Taraflar, s\u00f6zle\u015fme s\u00fcresince ve s\u00f6zle\u015fmenin sona ermesinden sonra da haberdar olduklar\u0131 t\u00fcm i\u015f ve ticari s\u0131rlara ili\u015fkin gizlili\u011fi korumay\u0131 kar\u015f\u0131l\u0131kl\u0131 olarak taahh\u00fct ederler. Bu gizlilik y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, a\u00e7\u0131k\u00e7a gizli olarak belirlenmi\u015f bilgileri de kapsar. Kamunun eri\u015fimine a\u00e7\u0131k bilgiler veya if\u015fas\u0131 kanunla \u00f6ng\u00f6r\u00fclen ya da \u00f6rne\u011fin yetkili makamlara veya mahkemelere if\u015fas\u0131 kanunen zorunlu olan bilgiler i\u00e7in ge\u00e7erli de\u011fildir.\u00a0<\/p><p>\u00a0<\/p><p><strong><strong>\u00a73 \u00dccret <\/strong>\n<br>\nVispair taraf\u0131ndan bir ba\u015fvuru sahibinin sunulmas\u0131ndan sonra, bu ba\u015fvuru sahibi ile m\u00fc\u015fteri aras\u0131nda bir i\u015f veya hizmet s\u00f6zle\u015fmesi imzalan\u0131rsa, yerle\u015ftirmenin Vispair taraf\u0131ndan ba\u015flat\u0131ld\u0131\u011f\u0131 reddedilemez. Bu durumda, Vispair m\u00fc\u015fteriden bir yerle\u015ftirme \u00fccreti alma hakk\u0131na sahiptir.<\/strong><br \/>Kommt es nach der Pr\u00e4sentation eines Bewerbers durch Vispair zwischen diesem Bewerber und dem Kunden zum Abschluss eines Arbeits- oder Dienstvertrages, gilt unwiderlegbar, dass die Vermittlung durch Vispair initiiert wurde. In diesem Fall entsteht Vispair ein Anspruch auf ein Vermittlungshonorar gegen\u00fcber dem Kunden.<\/p><p>\u00dccretin miktar\u0131 teklif veya yerle\u015ftirme s\u00f6zle\u015fmesinde belirlenir ve yerle\u015ftirilen \u00e7al\u0131\u015fan\u0131n br\u00fct y\u0131ll\u0131k maa\u015f\u0131n\u0131n bir y\u00fczdesi olarak tan\u0131mlan\u0131r. Yasal katma de\u011fer vergisi ayr\u0131ca tahsil edilir.\u00a0<\/p><p>Br\u00fct y\u0131ll\u0131k maa\u015f, g\u00f6n\u00fcll\u00fc \u00f6denekler, ikramiyeler, primler, 13.\/14. ayl\u0131k maa\u015flar ve ayni yard\u0131mlar dahil olmak \u00fczere s\u00f6zle\u015fmeyle kararla\u015ft\u0131r\u0131lan t\u00fcm \u00fccret bile\u015fenlerini i\u00e7erir.\u00a0<\/p><p>\u00dccret, i\u015f s\u00f6zle\u015fmesi imzalan\u0131r imzalanmaz veya yaz\u0131l\u0131 bir s\u00f6zle\u015fmenin olmamas\u0131 durumunda, i\u015fe yerle\u015ftirilen \u00e7al\u0131\u015fan\u0131n i\u015fe ba\u015flamas\u0131yla birlikte \u00f6denir. M\u00fc\u015fteri, hizmet veya i\u015f s\u00f6zle\u015fmesinin imzalanmas\u0131 hakk\u0131nda Vispair'i derhal bilgilendirmek ve talep \u00fczerine s\u00f6zle\u015fmenin imzalanma veya i\u015fe ba\u015flama zaman\u0131 ile br\u00fct y\u0131ll\u0131k maa\u015f\u0131n miktar\u0131 ve bile\u015fimi hakk\u0131nda yaz\u0131l\u0131 bilgi vermekle y\u00fck\u00fcml\u00fcd\u00fcr.\u00a0<\/p><p>\u00d6zel ko\u015fullar veya farkl\u0131 \u00f6deme \u015fekilleri ancak yaz\u0131l\u0131 olarak a\u00e7\u0131k\u00e7a kararla\u015ft\u0131r\u0131lm\u0131\u015fsa veya Vispair taraf\u0131ndan yaz\u0131l\u0131 olarak teklif edilmi\u015f ve m\u00fc\u015fteri taraf\u0131ndan yaz\u0131l\u0131 olarak kabul edilmi\u015fse ba\u011flay\u0131c\u0131d\u0131r.\u00a0<\/p><p>\u00a0<\/p><p class=\" translation-block\"><Strong>\u00a74 Reklamlar ve sunum masraflar\u0131<\/Strong>\n<br>\n\u0130lanlar veya i\u015f ilanlar\u0131 i\u00e7in masraflar yaln\u0131zca \u00f6nceden anla\u015fmaya var\u0131ld\u0131ktan sonra tahsil edilir. Ba\u015fvuru sahibinin m\u00fclakat masraflar\u0131, Vispair'in \u00f6nceden mutabakata varmadan m\u00fclakat\u0131 organize etmedi\u011fi durumlarda m\u00fc\u015fteri taraf\u0131ndan kar\u015f\u0131lan\u0131r.<\/p><p>\u00a0<\/p><p class=\" translation-block\"><strong>\u00a75 Sorumlulu\u011fun s\u0131n\u0131rland\u0131r\u0131lmas\u0131<\/strong>  \n<br>\nVispair, m\u00fc\u015fteri taraf\u0131ndan se\u00e7ilen aday\u0131n ki\u015fisel, karakter, mesleki veya fiziksel uygunlu\u011fu konusunda hi\u00e7bir sorumluluk kabul etmez. Se\u00e7im karar\u0131n\u0131n tek sorumlulu\u011fu, s\u00f6zle\u015fmenin imzalanmas\u0131 veya i\u015fe ba\u015flama an\u0131ndan itibaren m\u00fc\u015fteriye aittir. Vispair, yerle\u015ftirilen \u00e7al\u0131\u015fan\u0131n ifadelerinden, eylemlerinden veya yanl\u0131\u015f davran\u0131\u015flar\u0131ndan sorumlu de\u011fildir.<\/p><p>\u00a0<\/p><p class=\" translation-block\"><strong>\u00a76 Garanti <\/strong>\n<br>\n\u00c7al\u0131\u015fanlar\u0131n i\u015fe yerle\u015ftirilmesi herhangi bir garanti olmaks\u0131z\u0131n ger\u00e7ekle\u015fir. Ancak, iyi niyet g\u00f6stergesi olarak, Vispair, i\u015fe yerle\u015ftirilen \u00e7al\u0131\u015fan\u0131n i\u015fe ba\u015flad\u0131ktan sonraki 6 ay i\u00e7inde kendi iste\u011fiyle i\u015ften ayr\u0131lmas\u0131 halinde, yerine uygun birini bulmaya \u00e7al\u0131\u015facakt\u0131r. Vispair bu yeni yerle\u015ftirme i\u00e7in ba\u015flang\u0131\u00e7ta kararla\u015ft\u0131r\u0131lan \u00fccretin ini talep edecektir. Bu d\u00fczenleme, i\u015f ili\u015fkisinin operasyonel nedenlerle sona erdirilmesi halinde uygulanmaz.<\/p><p>\u00a0<\/p><p class=\" translation-block\"><strong>\u00a77 Alternatif s\u00f6zle\u015fme ili\u015fkileri  <\/strong>\n<br>\nM\u00fc\u015fteri ile i\u015fe yerle\u015ftirilen aday aras\u0131nda bir i\u015f s\u00f6zle\u015fmesi yerine ba\u015fka bir s\u00f6zle\u015fme ili\u015fkisi (\u00f6rne\u011fin bir ticari acente veya serbest meslek s\u00f6zle\u015fmesi) imzalan\u0131rsa, 3. b\u00f6l\u00fcmdeki \u00fccretlendirme ve di\u011fer ko\u015fullara ili\u015fkin h\u00fck\u00fcmler buna g\u00f6re uygulan\u0131r.<\/p><p>\u00a0<\/p><p class=\" translation-block\"><strong>\u00a78 Son h\u00fck\u00fcmler  <\/strong>\n<br>\nVispair, ki\u015fisel verilerin m\u00fc\u015fteriye aktar\u0131lmas\u0131 i\u00e7in ba\u015fvuru sahibinin onay\u0131n\u0131 ald\u0131\u011f\u0131n\u0131 garanti eder. M\u00fc\u015fteri, i\u015fe al\u0131m ajans\u0131n\u0131n g\u00f6revlendirilmesinden sorumlu irtibat ki\u015fisinin yetkili ve imzalamaya yetkili oldu\u011funu onaylar.<\/p><p>S\u00f6zl\u00fc teminat anla\u015fmalar\u0131 ge\u00e7erli de\u011fildir. Bu Genel H\u00fck\u00fcm ve Ko\u015fullarda yap\u0131lacak de\u011fi\u015fikliklerin veya eklemelerin ge\u00e7erli olabilmesi i\u00e7in yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gerekir. Bu h\u00fck\u00fcm ve ko\u015fullar\u0131n m\u00fcnferit h\u00fck\u00fcmlerinin ge\u00e7ersiz olmas\u0131 halinde, bu durum kalan h\u00fck\u00fcmlerin ge\u00e7erlili\u011fini etkilemeyecektir. Taraflar, ge\u00e7ersiz bir h\u00fckm\u00fc, ekonomik amaca kar\u015f\u0131l\u0131k gelen yasal olarak izin verilebilir bir h\u00fck\u00fcmle de\u011fi\u015ftirmeyi taahh\u00fct eder.\u00a0<\/p><p>\u00a0<\/p><p><strong><strong>\u00a79 Hukuk se\u00e7imi ve yarg\u0131 yeri  <\/strong>\n<br>\nVispair ve m\u00fc\u015fteri aras\u0131ndaki i\u015f ili\u015fkisi Alman yasalar\u0131na tabidir. S\u00f6zle\u015fmeye dayal\u0131 ve s\u00f6zle\u015fme d\u0131\u015f\u0131 t\u00fcm anla\u015fmazl\u0131klar i\u00e7in m\u00fcnhas\u0131r yarg\u0131 yeri Braunschweig'd\u0131r.<\/strong><br \/>Die Gesch\u00e4ftsbeziehung zwischen Vispair und dem Kunden unterliegt deutschem Recht.
